Terms of service

01Applicable

These Terms and Conditions define the conditions for the provision of this service and the rights and obligations between all users of this service (hereinafter referred to as "Users") and our studio. Users are deemed to have agreed to these Terms and Conditions at the time they use this service.

02Definition

1. A "box" refers to a unit on this service for storing and sharing photos and other permitted files.
2. "Posted data" refers to photos, text, descriptions, file names, and other information that users upload or enter into this service.
3. "Box creator" refers to a user who logs in with an X account and creates a box.
4. "Participants" refers to users who access Box via a shared URL, password, X account, or other means, and who view, download, or upload content.

03Agreement to these Terms and Conditions

1. If you do not agree to these terms and conditions, you may not use this service.

04Authentication via X account

1. Creating boxes and using some other features requires logging in with an account provided by X.
2. Users are responsible for properly managing their X accounts and taking necessary measures to prevent unauthorized use by third parties.
3. You may be unable to use all or part of this service due to suspension, deletion, specification changes, authentication failures, or other issues with your X account.
4. Actions performed using a user's X account will be considered as actions performed by that user, except in cases where the studio is at fault.

05Overview of this service

1. This service is a free service that allows you to upload, view, share, and download photos taken at events, meetups, parties, weddings, and other occasions through a box.
2. Users can download either the original size or a reduced size generated by our studio, depending on their environment.
3. Even if there is no fixed service limit on the number of photos that can be uploaded to the box, our studio may impose technical restrictions on data usage, file size, number of simultaneous processes, and other factors for system protection, fair use, and legal compliance.
4. This service is not intended for permanent storage, backup, or archiving.

06Boxes and access restrictions

1. The box creator can set access restrictions using methods provided by this service, such as "only those who know the URL," "only mutual followers," "only those who know the password," "only specified people," and others.
2. Those who receive a shared URL or password may forward them to third parties. Access restrictions do not guarantee complete identification of viewers or complete prevention of information leaks.
3. The box creator is responsible for managing the recipients, passwords, and designated accounts.
4. On the event-specific page, authorized participants may be able to upload submitted data. The box creator is responsible for informing participants of these terms and conditions and taking necessary measures to manage them.

07Retention period and deletion

1. As a general rule, submitted data can be downloaded for 31 days from the date of upload. If an individual scheduled deletion date is displayed on the screen, that date takes precedence.
2. Posted data may be deleted due to the expiration of the retention period, deletion by the box creator, violation of the terms of service, system maintenance, or other reasons.
3. Deleted posts may not be recoverable. Users should save any necessary posts to their own devices within the retention period.
4. Deleted data may remain in backup, cache, or disaster recovery data for a period of time that is technically necessary.

08Rights to submitted data

1. Copyright and other rights related to submitted data belong to the user or the rightful owner, and our studio does not acquire ownership of them.
2. Users guarantee that they have the necessary rights or licenses to upload, share, and make their posted data available for download.
3. For photographs taken by third parties, photographs containing people, and photographs including facilities, works, trademarks, etc., users are responsible for obtaining the necessary permissions.

09Licenses required for providing the service

1. Users grant the studio a non-exclusive, royalty-free right to reproduce, convert, publicly transmit, and otherwise use their submitted data to the extent necessary for providing, storing, transmitting, displaying, generating thumbnails, resizing, ZIP compression, preventing misuse, troubleshooting, and maintenance of this service.
2. The permission granted in the preceding paragraph is limited to the purpose of providing this service and does not imply that our studio will arbitrarily use the user's submitted data as advertising material.
3. Your permission will terminate upon deletion of your posted data, except to the extent required by law, for dispute resolution, or for technically reasonable purposes.

10User responsibility

1. Users are solely responsible for their own actions and posted data.
2. Users should create necessary backups before posting and ensure that sharing destinations and access restrictions are appropriate.
3. If a dispute arises with a third party regarding posted data or the use of this service, the user shall resolve it at their own responsibility and expense. However, this does not apply in cases where the dispute is due to reasons attributable to our studio.

11Prohibitions

Users must not engage in the following actions:

1. Acts that violate laws or public order and morals
2. Actions that infringe on the copyrights, portrait rights, privacy rights, reputation rights, trademark rights, or other rights of third parties.
3. Posting illegal or harmful content, including child sexual exploitation, obscene material, violent or discriminatory content is prohibited.
4. Harassment, threats, stalking, impersonation, fraud, or acts that cause harm to third parties
5. The act of transmitting malware, computer viruses, or harmful programs.
6. Actions that place an excessive load on this service or server and disrupt its operation.
7. Acts of circumventing access control, authentication, communication restrictions, and other technical safeguards.
8. Unauthorized automated acquisition, scraping, reverse engineering, or vulnerability exploration
9. Unauthorized acquisition, use, or provision of shared URLs, passwords, or other people's accounts.
10. Reselling this service or using it as a commercial file distribution platform without the permission of our studio is prohibited.
11. Any other conduct that our studio reasonably deems inappropriate.

12 Deletion and restriction of use of posted data

1. Our studio may delete, suspend publication of, disable or restrict the use of posted data without prior notice if the posted data violates these terms and conditions or applicable laws, infringes on the rights of third parties, harms the security of this service, or is in an urgent situation.
2. Our studio may store, disclose, or delete submitted data based on laws or orders from authorized public authorities.
3. Our studio may request users' cooperation in investigations regarding suspected violations.

13External services

1. This service may integrate with services, websites, or features provided by X or other third parties.
2. Use of external services is subject to the terms of service and privacy policy of the respective service provider.
3. Our studio is not responsible for the content, continuity, security, or changes in specifications of external services, or for any disputes between users and external service providers, except where required by law.

14Intellectual property rights of this service

Copyright, trademark rights, and other intellectual property rights relating to the software, designs, logos, text, images, and other materials (excluding submitted data) that constitute this service belong to our studio or the rightful owners. These terms and conditions do not grant users the right to use these materials beyond what is necessary for using this service.

15Changes, interruptions, and termination of this service

1. Our studio may change or temporarily suspend all or part of this service due to maintenance, malfunctions, security requirements, legal compliance, natural disasters, communication failures, or other unavoidable circumstances.
2. Our studio may terminate this service after providing reasonable prior notice. However, in emergency situations, notice may be given afterward.
3. Users acknowledge that this service is provided free of charge and that its features, capacity, supported formats, or storage period may be subject to change.

16Disclaimer of warranty

1. Our studio does not guarantee that this service will be available at all times, that it will be free from errors and interruptions, that submitted data will not be lost or corrupted, that it will work on all devices, or that it will be perfectly suited to your intended use.
2. The access restrictions that can be set in this service do not completely prevent third parties from viewing, copying, resharing, taking screenshots, or engaging in other similar activities.
3. This studio does not guarantee the accuracy, legality, or safety of any data posted, viewed, or downloaded by users.

17Limitation of Liability

1. Except in cases of willful misconduct or gross negligence on the part of our studio, we shall not be liable for any damages arising from the use or inability to use this service, loss or damage of posted data, viewing or use by third parties, failures of external services, or any other matters related to this service.
2. Even if our studio is held liable under the Consumer Contract Act or other laws and regulations, our liability for slight negligence shall be limited to ordinary and direct damages.
3. This clause does not exclude liability that cannot be limited or exempted by law.

18Personal information and privacy

Our studio's handling of personal information is governed by our separate privacy policy . When sharing photographs or other personal information that can identify individuals, users must confirm the purpose and scope of sharing and obtain the necessary consent.

19Changes to these Terms and Conditions

1. Our studio may modify these terms and conditions if necessary due to changes in laws and regulations, changes in the functionality of this service, prevention of misuse, or other reasonable requirements.
2. In the event of significant changes, we will notify users of the changes and their effective date through postings on this service or other reasonable means.
3. If you use this service after the effective date of the changes, you will be deemed to have agreed to the revised terms and conditions.

20Governing Law and Jurisdiction

1. These Terms and Conditions shall be governed by and construed in accordance with Japanese law.
2. In the event of any dispute arising in connection with this service or these terms and conditions, the user and the studio shall endeavor to resolve the dispute through good-faith discussions.
3. If the matter cannot be resolved through negotiation, the Saitama District Court or the Kasukabe Summary Court shall be the exclusive court of first instance with agreed jurisdiction. However, this shall not apply if the provision for exclusive agreed jurisdiction is not permitted by law.
